Terms and Conditions



By renting our product you expressly agree to the following terms and conditions:

Disclaimer: By renting our forever floral arrangements you understand that although some of these flowers appear fresh, and are named after fresh flowers found in nature, some of them are in fact artificial, and therefore only resemble the fresh flower for which they are named after or referred to. 

Payments: We offer 2 payment options: Full payment is due up front, or SHOP PAY, which splits rental fees into multiple payments. Hummingbird Fine Floral Rental offers this service as a convenience to our clients.  Use of the SHOP PAY convenience is not required and Hummingbird does not receive any commission, percentage of retainer (rental) fees, or any other form of compensation for use of this service.  In and All Terms associated with SHOP PAY Agreements are between the client and SHOP PAY and in no way involve or include Hummingbird Fine Floral Rental as part of that finance agreement, with the exception of receipt of payments due to Hummingbird Fine Floral Rental for advertised, and agreed upon rental fees.  

All retainers (% rental fee) of at least 25% of the total balance must be submitted with all orders. The retainer is deducted from the total price of the wedding/event.

Balance due must be paid in full at least 30 days prior to the wedding/event. If payment of balance due is not made, all retainer agreements (% rental fee agreements) and this contract will be closed at the determination of Hummingbird Fine Floral Rentals.  If the contract includes fresh flowers and additional décor, neither will be ordered for the wedding/event.  If Hummingbird Fine Floral Rentals determines the retainer agreement(s) and the full contract can still be fulfilled after this date and you wish to continue the contract, there will be a 10% fee added to the balance due and an additional 10% fee for each 7 days that the balance is late. Any extraordinary costs incurred due to the late payment will be passed on to you.

Additions less than 30 days prior to the wedding/event will be accepted up to 7 days prior to the wedding/event and must be paid within 24 hours. No guarantee is given that the same flowers will be available, and pricing will be determined according to what is available. Color and style will be matched as closely as possible.

Substitutions: When adding floral to an existing piece, Hummingbird Fine Floral Rentals reserves the right to make substitutions in the event the flowers or decor received are not of the quality suitable for a wedding/event. The integrity of the proposed look and color scheme will be maintained, and flowers of equivalent value will be used. Hummingbird Fine Floral Rentals will inform you if a dyed flower is being used and will not be held liable for staining any garments due to their usage.

Terms: At the time of the initial retainer (% rental fee), adjustments can still be made to the invoice. Large additions and subtractions are accepted up until the balance is paid in full. There is a guaranteed minimum payment of 85% of the original proposal. Any liability on the part of Hummingbird Fine Floral Rentals is limited to the full refund of monies paid minus the retainer fee.

When adding floral to existing pieces, fluctuating flower prices may result in a price increase and will be passed onto the customer via separate invoice. The customer will be notified as soon as Hummingbird Fine Floral is made aware of these increases. Hummingbird Fine Floral will send the customer said invoice for the additional cost, to be paid within 30 days of the event. 

Price is for 1 setup/location only. Additional fees will apply if the desired rental item is to be moved from the ceremony to the reception, or any other physical location. If you need any item moved from the ceremony to the reception, or any other physical location, an additional moving and setup fee will be required. Our arches, arbors, pillars, and backdrops are very large and do not fit through normal doorways. They must be dissembled, which will require our movers and/or florist to remove the florals, dissemble the item, transport it to the new location, then reassemble, and re-apply the florals. We require our own team to move any items. This is due to insurance reasons, which will not cover anyone outside of our team to handle our pieces.

It is your (The Client, Client's Representative, Wedding Coordinator/Wedding Planner) to clearly communicate with your venue to confirm our rentals will fit in the desired space and that they can be moved through the venue doorways, hallways, elevators, stairways for placement access.  Any orders that cannot be fulfilled due to space or delivery limitations are not the responsibility of Hummingbird Fine Floral Rentals.  No refunds for lack of deliverability will be provided.

All orders include free delivery, setup, and pick-up if the following parameters are met:  Delivery is within 50 miles of our warehouse in Bowling Green, KY,  there is only one venue location required for delivery, one set-up location and one pick-up location, and pickup time is no later than 9:00 PM.   Pickups past 9:00 PM will incur an additional fee; see schedule below. Multiple delivery locations and/or additional set-up sites will require associated fees for staff time/travel to safely set designs as desired by the client.  

Delivery costs for orders outside of 50 miles is based on 1 dollar per mile but, final costs will include consideration of wedding/event location and whether the delivery involves setup from our movers and/or florist, final pick-up time and size of team needed to facilitate all.  Please email us and we can give you a quote for this price based off these factors. 

Late Pick-up Fee Schedule

ALL pickups past 9:00 PM will incur an additional fee based on the actual time of the pick-up, which can be found in the schedule below:

  • 9:30PM charge of $50
  • 10:00 PM charge of $100
  • 10:30 PM charge of $150
  • 11:00 PM charge of $200
  • 11:30 PM charge of $250
  • 12:00 AM charge of $300

Product Handling: No rentals can be left outside overnight, including the Arbors, Arches, Pillars, Bourbon Barrels, Floral Urns, or Flowers Wall Backdrops of any kind, as well as all Floral Arrangements. Our products are not water resistant.  No rentals can be in the rain due to imminent damage. If there is rain forecasted, and the rentals are to be in an exposed, outside location, our delivery team will be dispatched to remove the items early.  Due to strict insurance regulations, no rental items are to be taken down, moved, or transported without our express prior written approval.  Hummingbird Fine Floral is not responsible for losses incurred due to inclement weather or event site restrictions. 

During rental, any damage incurred to Hummingbird Fine Floral Rental products will be charged to your provided credit card in the amount of 2x the associated rental agreement fees.  If an item is not returned within the rental agreement timeline, the credit card will be charged 4x the rental costs of each item within the rental agreement and you will be allowed to keep said rental items.  Your credit card information is safely stored within our system and is auto-deleted once all items have been returned with no damage.  

All wedding/event décor (i.e.: tents, tables, lanterns, candle vessels, drapery, etc.) must be communicated to Hummingbird Fine Floral Rentals to preserve the design integrity and safety of the wedding/event. Any décor for the wedding/event not provided by Hummingbird Fine Floral Rentals is not guaranteed by Hummingbird Fine Floral Rentals even in cases where Hummingbird Fine Floral Rentals items are integrated. In such cases, any alterations deemed necessary by HFFR will be made to preserve the design integrity and safety related to the use of our rentals and Hummingbird Fine Floral Rentals will be blameless.

Venue and Location Limitations: Hummingbird Fine Floral Rentals is limited by the rules and guidelines of the event/wedding venue(s), their unique location(s) and on-site management. Negotiation with on-site officials for modification of venue guidelines is the express responsibility of The Client or the Client's representative; Hummingbird Fine Floral Rentals will offer technical recommendations only. Reimbursements will not be made for unused items due to venue limitations not communicated timely to Hummingbird Fine Floral Rentals.  This includes impassable rental delivery passages, doorways, stairways, elevators, balconies, windows, etc.  If our team is required to disassemble and reassemble an item to ensure delivery, additional fees will apply.  Delivery will not be completed until The Client is notified of this circumstance, and all additional associated fees are agreed to.  All agreed to “Day-of/ On-site” delivery/pick-up fees will be submitted to The Client via separate invoice and due within 30 days of the event/wedding. 

Cancellations: We strictly require a 90-day cancellation notice, otherwise any retainer fee(s) (rental fees) cannot be partially refunded. In the event of a war, fire, tragedy, pandemic, natural disaster, or other emergencies within 90 days of your wedding/event, we will move your retainer fee(s) (rental fees)- free of charge to another date. 

Retainers (rental fees) will not be refunded in full, they will exclude the payment processing fees, as well as costs related to any time we spent in communication with you, the time spent forming the proposal, any time spent working on your event preparations, fees charged by our banking institution for refunds, and may include the fees associated with us making this available online for you to rent online. 

Hummingbird Fine Floral Rentals reserves the right to cancel this contract if at any time Hummingbird Fine Floral Rentals feels that the obligations cannot be met. Hummingbird Fine Floral Rentals will credit the amount paid, minus any actual costs incurred up to that point that Hummingbird Fine Floral Rentals informs you of this decision.

Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules [including the Optional Rules for Emergency Measures of Protection]. The arbitration hearing shall take place in Bowling Green, Kentucky before a single arbitrator. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
